2. Overview

We only process personal data to the extent necessary to run this website, answer your enquiries and plan your tattoo project. We do not use any analytics or marketing tools and we do not share your data for advertising purposes.

The legal bases are in particular Art. 6(1)(a) GDPR (consent), (b) (contract and pre-contractual measures), (c) (legal obligation) and (f) (legitimate interest).

3. Hosting and server log files

This website is hosted by Hostinger International Ltd., 61 Lordou Vironos Street, 6023 Larnaca, Cyprus. When you visit the website, the server automatically records information sent by your browser: IP address, date and time of access, page visited, referrer URL, and browser and operating system used (server log files).

This data is technically necessary to provide the website securely and reliably. The legal basis is Art. 6(1)(f) GDPR. Log files are deleted automatically after a short period. A data processing agreement pursuant to Art. 28 GDPR is in place with the host.

4. SSL/TLS encryption

For security reasons, this website uses SSL/TLS encryption. You can recognise an encrypted connection by “https://” in your browser’s address bar.

5. Cookies and consent

This website only uses cookies that are technically necessary for its operation, for example to store your language choice and your cookie settings. The legal basis is § 25(2) TDDDG in conjunction with Art. 6(1)(f) GDPR.

We use the WordPress plugin Complianz to manage your consent. It runs on our own server; no data is sent to the plugin provider. Your choice is stored in a cookie so that we can respect it on your next visit. You can change your settings at any time via the “Cookie settings” link in the footer.

Should we use services that require consent in the future, they will only be loaded after you agree (Art. 6(1)(a) GDPR, § 25(1) TDDDG).

6. Project requests via our form

If you contact us via the request form, we process the data you enter (e.g. name, email address, phone number, description of your project and, where applicable, reference images) to answer your request and plan your project. The legal basis is Art. 6(1)(b) GDPR (pre-contractual measures).

The form is provided via the HighLevel / LeadConnector software (HighLevel LLC and LeadConnector LLC, Dallas, Texas, USA). Your entries are stored there and forwarded to us. A data processing agreement is in place with the provider. Data is transferred to the USA on the basis of the EU-U.S. Data Privacy Framework, under which the provider is certified (adequacy decision pursuant to Art. 45 GDPR).

Please do not send us health data via the form. Health questions relevant to tattooing are discussed in person before your appointment.

We delete your request once it has been dealt with, unless statutory retention obligations apply. If an appointment takes place, we keep the data required for invoicing in line with tax and commercial retention periods (up to ten years).

7. Contact by email or phone

If you contact us by email or phone, we process your details to handle your enquiry. The legal basis is Art. 6(1)(b) GDPR where your enquiry relates to an appointment or project, otherwise Art. 6(1)(f) GDPR. The data is deleted as soon as it is no longer needed and no retention obligations apply.

8. Instagram and Google Maps

Our website contains links to our Instagram profile (Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K6, Ireland) and to our location and reviews on Google (Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland). These are simple links: no data is transferred to these providers when you visit our website. Only when you click a link are you taken to the provider’s site, where its privacy policy applies.

Meta is responsible for data processing when you visit our Instagram profile. We are jointly responsible with Meta for the statistical analysis of profile visits (Insights) (Art. 26 GDPR).

9. Fonts

The fonts used on this website are loaded locally from our own server. No connection is made to servers of Google or any other provider.

10. Your rights

You have the right at any time to access the data stored about you (Art. 15 GDPR), and to rectification (Art. 16 GDPR), erasure (Art. 17 GDPR), restriction of processing (Art. 18 GDPR) and data portability (Art. 20 GDPR). You can withdraw any consent you have given at any time with effect for the future (Art. 7(3) GDPR).

Right to object: Where we process data on the basis of Art. 6(1)(f) GDPR, you may object to the processing at any time on grounds relating to your particular situation (Art. 21 GDPR).

To exercise your rights, simply send an email to info@fenixtattoostudio.com.

11. Right to lodge a complaint

You have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR). The authority responsible for us is the Unabhängiges Landeszentrum für Datenschutz Schleswig-Holstein (ULD), Holstenstraße 98, 24103 Kiel, Germany.
